These Terms of Service apply to your use of The Milk Bar Fishing Supply website and to purchases made from The Milk Bar Fishing Supply.
By accessing our website or placing an order, you agree to these Terms of Service.
Throughout these Terms, “we”, “us” and “our” refer to The Milk Bar Fishing Supply.
1. AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law.
If there is any inconsistency between these Terms and a right provided to you by law that cannot be excluded, the law will apply.
2. OUR STORE
The Milk Bar Fishing Supply is an Australian fishing tackle retailer specialising in premium fishing equipment, including new, pre-loved, imported, rare and hard-to-find fishing tackle.
Products may include fishing lures, rods, reels, terminal tackle, accessories, apparel and other fishing-related products.
3. PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, specifications, photographs, prices and availability are accurate.
Because many of our products are imported, handmade, limited-production, pre-loved or individually finished, minor differences may exist between products.
Product colours may also appear differently depending on lighting and the screen or device being used.
If a product is materially different from its description, your rights under Australian Consumer Law may apply.
4. PRE-LOVED PRODUCTS
Pre-loved products are sold based on their condition at the time of sale.
These products may contain signs of previous use including scratches, marks, wear, fading, packaging damage or cosmetic imperfections.
We endeavour to disclose and photograph relevant wear and known imperfections.
By purchasing a pre-loved product, you acknowledge any condition or imperfections that were clearly disclosed before purchase.
This does not exclude your rights regarding faults or problems that were not disclosed.
5. ORDERS
Submitting an order does not necessarily guarantee that the product is available or that the order will be accepted.
We may cancel or decline an order where reasonably necessary, including where:

a product has sold out or is unavailable;

an obvious pricing or listing error has occurred;

payment has not been authorised;

we reasonably suspect fraudulent activity;

an incorrect product quantity or inventory level has been displayed; or
-
we are unable to fulfil the order.
Where we cancel an order after payment has been received, the amount paid for the cancelled item will be refunded.
6. LIMITED & HIGH-DEMAND PRODUCTS
Certain products may be released in limited quantities.
We may impose purchase limits, including limits per customer, household, account or order.
Where a purchase limit is clearly stated, we reserve the right to cancel quantities purchased in excess of that limit and refund the affected amount.
This helps us provide fair access to limited products.
7. PRICING
All prices are displayed in the currency shown on the website.
We reserve the right to change prices at any time before an order has been accepted.
If an obvious pricing error occurs, we may contact you to provide the option of purchasing the item at the correct price or cancelling the affected item for a refund.
Nothing in this section permits us to engage in misleading pricing practices or otherwise limits your rights under Australian Consumer Law.
8. PAYMENT
Orders must be paid using one of the payment methods available through our website.
You agree to provide accurate and authorised payment information.
Your order may be delayed or cancelled if payment cannot be authorised or verified.
9. SPECIAL ORDERS & PRODUCT SOURCING
From time to time, The Milk Bar Fishing Supply may assist customers in sourcing rare or difficult-to-find fishing tackle.
Once a special order or sourcing request has been confirmed and sourcing has commenced, cancellations for change-of-mind reasons may not be accepted.
Any specific deposit, payment or sourcing conditions communicated before confirming the order will form part of the agreement for that purchase.
Your rights under Australian Consumer Law continue to apply.
10. SHIPPING & DELIVERY
Customers are responsible for providing complete and accurate delivery information when placing an order.
We are not responsible for delays caused by circumstances reasonably outside our control, including postal or courier delays.
Estimated delivery times are estimates only unless we expressly agree otherwise.
If an incorrect delivery address is provided by the customer and the parcel is returned to us, additional postage charges may apply before the order is resent.
If we have made the addressing or fulfilment error, we will arrange an appropriate remedy.
11. LOST OR DAMAGED PARCELS
If your parcel appears to be lost or arrives damaged, please contact us as soon as reasonably possible.
We may work with the relevant courier or postal provider to investigate the shipment.
Nothing in this section limits any rights you may have under Australian Consumer Law.
12. RETURNS & REFUNDS
Returns, refunds and exchanges are governed by our Refund & Returns Policy and Australian Consumer Law.
We do not generally provide refunds or exchanges for change of mind.
This does not affect your rights where a product fails to meet a consumer guarantee.
13. PRODUCT USE
Fishing equipment should be used for its intended purpose and within the manufacturer's recommended specifications.
The Milk Bar Fishing Supply is not responsible for damage caused by misuse, incorrect rigging, modification, improper maintenance, using equipment outside its intended specifications, or normal wear and tear.
This section does not exclude liability that cannot legally be excluded.
14. WEBSITE CONTENT
All branding, logos, graphics, photographs, written content and other original material appearing on The Milk Bar Fishing Supply website remain the property of The Milk Bar Fishing Supply or the relevant rights holder unless otherwise stated.
You may not reproduce, distribute, commercially use or represent our original content as your own without permission.
15. THIRD-PARTY PRODUCTS & BRANDS
References to manufacturers and brands on our website are used to accurately identify the products we sell.

Nothing in this clause limits any rights you may have under applicable consumer protection legislation.
